  • AB 2293 Transportation Network Companies Insurance Coverage

    Summary:
    AB 2293 (Bonilla) Motor Vehicle Insurance Coverage Personal Vehicle Sharing. Provides disclosure to transportation network company drivers that likely inapplicability of their personal auto coverage, clarifies that TNC coverage is primary, defines transportation network services as “app on,” and clarifies that the TNC has the duty to defend and indemnify. The bill is scheduled to be heard in the Assembly Utilities and Commerce Committee on April 28. ACIC is co-sponsor and supports the bill.

  • AB 1309 Workers Compensaiton: Professional Athletes

    AB 1309 Exempts professional athletes from California’s workers’ compensation law who are working temporarily within the state. The bill also defines date of injury and provides that an employer of a professional athlete that is subject to California's workers' compensation laws is not liable for occupational disease or cumulative injury under specified conditions. ACIC and members of the insurance coalition have been meeting with members to answer technical questions.

  • ACIC Opposes SB 604 Insurance Guarantee Associaiton: Definitions

    Summary:
    SB 604 seeks to create an exception for a self-insured public entity from statutes and numerous court decisions that hold a special employer liable when the general employer workers’ compensation benefits fails. If this bill were enacted, the liability for these benefits would be transferred to all employers insured for workers’ compensation. Since most large employers are self-insured for workers’ compensation the liability would fall on all of the small and medium sized employer whose workers’ compensation premiums are surcharged by the California Insurance Guaranty Association (CIGA).

  • ACIC and Other Oganizations Support SB 593 Residential Units For Tourist Use

    Summary:
    Insurers support innovation and believe that disclosing insurance information to hosts of hosting platforms as part of the agreement is sound public policy. In particular, we believe that hosting platforms should disclose to their hosts to either check their home or renters’ policy to ensure that there is appropriate insurance coverage should an injury or loss occur related to the activities under a hosting platform. As part of that disclosure, if a host’s coverage is insufficient, then he or she should be encouraged to obtain the appropriate insurance coverage.

  • ACIC and Other Organizaations Oppose SB 585

    Summary:
    SB 585 (Leyva) Insurance Payments Interception. Creates the Insurance Payment Intercept Program which requires the Department of Child Support Services to facilitate a data match system using automated data exchanges through which an insurer or self-insurer would be required to report special information for each claimant to match a claimant who owes past due support. Also authorizes the commissioner, in his or her discretion, to impose a fine, not to exceed $1,000, upon an insurer or self-insurer who violates the bill’s requirement to provide claim data. The bill was scheduled to be heard in the Assembly Insurance Committee on July 8, 2015. The hearing was cancelled at the request of the author. This is a two-year bill. ACIC opposes the bill, unless amended.

  • ACIC and Other Organizations Oppose Workers' Compensation: Utilization Review

    Summary:
    SB 563 (Pan) Workers' Compensation Utilization Review. Requires each employer, insurer, or other entity that is subject to the utilization review process to disclose the payment methodology for each person who is involved in the process of reviewing, approving, modifying, delaying, or denying requests by physicians for authorization prior to, retrospectively to, or concurrently with the provision of medical treatment services to injured workers by providing this information to employees, physicians, and the public upon request. The bill was scheduled to be heard in the Senate Appropriations Committee on May 28, 2015. The bill was held under submission and is a two-year bill. ACIC opposes the bill.

  • ACIC Opposes SB 465 Contractors: Discipline

    Summary:
    Requires contractors to report any civil action settlement or administrative action resulting in a settlement worth $50,000 or more, or a binding arbitration or administrative action resulting in binding arbitration worth $25,000 or more, resulting from specified acts. Failure to comply with this requirement would be grounds for disciplinary action. The bill would also require any insurer. The bill also requires insurers providing professional liability insurance to report within 30 days of payment of all or any portion of a civil action settlement or arbitration award against a contractor. The bill is scheduled to be heard in the Assembly Business and Professions Committee on July 14, 2015. ACIC opposes the bill.

    SB 623 (Lara) Workers' Compensation Benefits. Provides that a person shall not be excluded from receiving benefits under the Uninsured Employers Fund or the Subsequent Injuries Benefits Trust Fund based on his or her citizenship or immigration status. The bill is scheduled to be heard in the Assembly Appropriations Committee on July 8, 2015. ACIC supports the bill.

    SB 251 Authorizes certain notices and disclosures relating to renewal and conditional renewal of an offer of coverage for automobile and specified property insurance and workers’ compensation to be provided by electronic transmission if an insurer complies with certain requirements. The bill retains CA UETA and the governing law for electronic renewals and provides a five year sunset as part of the agreement reached with the California Department of Insurance (CDI), which amendments removed CDI and trial lawyers opposition. ACIC sponsored bill. The bill was signed by the Governor.
